EU Court Prevents Italy to Ban Online Gaming



Casinowebscripts, the premier gaming company which creates top gaming solutions for operators who seek to buy games for online casinos, has information regarding recent declarations made by the Court of Justice of the European Union, in which it has been stated that Italy will not be allowed to ban any online gambling sites that are based in another EU member state in order to favor their own financial interest. Italy used to hold a blacklist of internet gaming and betting operators, following the example of Belgium, whose regulations are highly criticized by the EU Court which considers that they are against the principles on which the gaming industry in the EU is founded.
The Court explained that if any member state tries to restrict other EU operators licensed in another EU state who are willing to offer their products to residents of that certain country, it means that it is not acting in accordance with the EU law. Under Articles 43 EC and 49 EC, the Court explained that if an online operator holds a gaming license in an EU territory, any other EU member state must allow that certain operator to offer betting and gaming services to any other EU country, if the gaming license complies with the EU law and it is issued by that state’s own authorities.
